1. Who we are
UsedPlasticMachinery.co.uk (“the site”) is run by Technical Welding Services (Rochdale) Ltd (“TWS”, “we”, “us”), Corporation Road, Sparth Bottoms, Rochdale OL11 4HJ, UK. Company No. 1721119. VAT No. 388 4169 06. Email: upm@tws-mail.co.uk.
By using the site you agree to these terms. If you don't agree, please don't use it. Our privacy notice explains how we use personal information.
2. What the site is
The site is a classified-ads marketplace for used machinery, equipment and surplus materials for the plastics, rubber and feed industries, and for “wanted” ads. Browsing, registering, posting Wanted ads and sending enquiries are free. For sale ads have a one-off admin fee (see section 4a).
We are not a party to any sale. Any deal is made directly between the buyer and the seller. We don't own, inspect, hold, deliver or guarantee the items advertised (apart from items we advertise ourselves, see section 8), we don't handle payments between buyers and sellers (the only payment we take is our own ad fee), and we can't promise that an item is as described, that a seller or buyer is who they say they are, or that a sale will go through. Before you buy, check the item, the seller and the paperwork yourself, and agree the terms of the sale (price, VAT, condition, collection or delivery, any guarantee) directly with the other party.
3. Accounts
- You need an account to post ads. You don't need one to browse or to send an enquiry.
- We check new accounts and may refuse one without giving a reason. Give accurate details and keep them up to date.
- Keep your password private. You're responsible for what's done with your account. Tell us straight away at upm@tws-mail.co.uk if you think someone else has used it.
- You can delete your account at any time under Your account.
4. Posting ads
If you post an ad, you are responsible for it. You confirm that:
- the ad is accurate and not misleading, including the description, condition, photos, price and location, and you'll update it, or mark it reserved or sold, when things change;
- you own the item, or have the legal right to sell it, and nothing stops you selling it (for example finance, a lease or a claim by someone else) unless you say so clearly in the ad;
- the item can legally be sold, and you'll meet any legal duties that apply to selling it (for example safety requirements for machinery, and consumer law if you sell to consumers);
- you have the right to use the photos, documents and text you upload, and they don't break anyone else's rights;
- you'll deal honestly and promptly with people who contact you.
Every ad is checked by us before it appears, and again if you change it. By posting an ad you allow us to show it on the site (including its photos and documents), to make small changes to its layout or category, and to keep it up until it's removed.
5. What you mustn't post or do
- Items that are stolen, counterfeit, unsafe or illegal to sell, or that you don't have the right to sell.
- False, misleading or duplicate ads, or ads for items that aren't really available.
- Ads that aren't for machinery, equipment, parts or materials for the plastics, rubber or feed industries (or wanted ads for them).
- Offensive, abusive, discriminatory or defamatory content, or someone else's personal information.
- Content that breaks copyright, trade marks or other people's rights.
- Spam, chain messages or advertising for other services through the enquiry forms, or using the forms to collect people's details.
- Anything that harms the site or its users: viruses, attempts to get into accounts or parts of the site you're not allowed to, or scraping or copying the site in bulk.
6. Our right to remove things
We can refuse, edit, hide or remove any ad, and suspend or close any account, at our discretion, for example if we think it breaks these terms, is inaccurate, or could harm other users or the site. We'll usually tell you why, but we don't have to.
7. Enquiries
The enquiry form sends your message and contact details to the person who posted the ad, with a copy to us. Only send genuine enquiries about the item. Sellers: only use enquirers' details to deal with their enquiry, and not for marketing.
8. Our own ads
4a. Admin fee and refunds
- For sale ads: £20 admin fee per ad (a one-off fee, including VAT where it applies). Wanted ads are free.
- You pay when you send the ad to us, through PayPal (with a PayPal account or by debit or credit card). We only start checking the ad once it's paid. If you don't pay within 7 days, the ad is withdrawn; you can send it again and pay later.
- The admin fee covers that one ad for as long as it's on the site. You can change it, mark it reserved or sold, or put it back up if a sale falls through, without paying again.
- If we don't approve your ad, you can change it and send it again without paying again. If you'd rather not, ask us and we'll refund the £20 admin fee in full, to the account you paid from.
- Once your ad has been approved and gone live, the admin fee is not refundable, including if you sell the item quickly, take the ad down or delete your account. If we remove a live ad because it breaks these terms, there's no refund either.
- If something goes wrong with a payment (for example you're charged twice), email upm@tws-mail.co.uk and we'll put it right.
- We may change the admin fee for new ads. The fee you pay is the one shown when you pay.
We sometimes advertise items ourselves (TWS). For those, we are the seller, and the terms of sale will be agreed with you directly; enquiries come straight to us.
9. Banner advertising and links
The site shows banner adverts and may link to other websites. We're not responsible for other websites or for what advertisers offer.
If you book a banner through Advertise with us:
- Top banner: £50 a month, or £100 for 3 months (including VAT where it applies).
- Sidebar & in-listing banner: £25 a month, or £50 for 3 months (including VAT where it applies).
- The top banner has one advertiser at a time. The sidebar & in-listing space is shared by up to 3 advertisers at a time, and each page view shows one of them at random, so you get roughly an equal share of the views in that space (more if fewer advertisers are booked). You pay when you book, through PayPal. The dates are held for an hour while you pay.
- We check every banner before it goes live. Your banner and the website it links to must be legal, honest and suitable for the trade, and you must have the right to use everything in it. If you ask us to design it, we'll send it to you to check first.
- If we can't run your banner (for example we turn down the artwork or the link), we'll refund you in full, to the account you paid from.
- Once your banner is live, there are no refunds, including if you want it taken down early. If we take a live banner down because it breaks these terms, there's no refund either.
- Your banner runs from the start date to the end date you booked, then stops by itself. We'll email you about 7 days before it ends. Banners show to visitors at random times and on different devices; we don't promise a number of views or clicks. We count views and clicks and can tell you the figures.
- Any free period we offer is at our discretion.
10. Our liability
- We provide the site “as is”. We try to keep it working and accurate but don't promise it will always be available or error-free.
- Because we are not a party to sales between users, we are not responsible for any item, ad, sale, payment, delivery or dispute between users, or for anything a user says or does.
- We are not liable for any indirect or consequential loss, or for loss of profit, business, contracts or data, arising from your use of the site.
- Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be limited or excluded by law. If you're a consumer, these terms don't affect your legal rights.
11. Changes
We may change these terms. The date at the top shows when they were last updated. If you keep using the site after a change, the new terms apply.
12. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute about them.
13. Contact
